Trial Fonts License Agreement
1. Definitions and License Grant
This Trial Fonts License Agreement (“Agreement”) is made between Plomb Type (“Licensor”) and you (“Licensee”).
By downloading, installing, or using a Trial Font, you agree to the terms of this Agreement.
Plomb Type grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Trial Fonts solely for evaluation, testing, experimentation, and educational purposes, as described below.
The Trial Fonts are provided to allow you to evaluate the Fonts before purchasing a commercial license.
1.1 Definitions
“Trial Fonts” means font software files made available by Plomb Type for testing or educational purposes.
The Trial Fonts are provided for evaluation purposes only and are not necessarily representative of the complete commercial version.
2. Permitted Uses
You may use the Trial Fonts solely for the following purposes:
Testing the Fonts within your workflow, software, or technical environment.
Exploring typographic possibilities and type pairings.
Creating internal mockups, prototypes, drafts, and design concepts.
Presenting design concepts to clients or collaborators for the purpose of obtaining approval before commercial production.
Using the Fonts in student or academic projects, provided that such projects are not created for commercial purposes.
Trial Fonts may be used in both personal and educational projects, provided that no commercial or published use occurs.
3. Commercial and public use
A commercial license is required for any final, published, distributed, or otherwise commercial use of the Fonts.
Without purchasing the appropriate commercial license, you may not use Trial Fonts for:
Final or published branding, identity, or logo work.
Commercial websites, applications, or digital products.
Advertising or promotional materials.
Packaging or products intended for sale.
Commercial publications or editorial work.
Broadcast or other commercial media.
Paid client work beyond the presentation and approval stage.
Any other commercial, public, or revenue-generating use.
If a project moves from testing, presentation, or educational use into final or public use, you must purchase the appropriate commercial license before such use takes place.
4. Character set and features
Trial Fonts are intentionally limited versions of the Fonts.
The glyphset may be incomplete and certain characters, languages, symbols, or typographic features available in the commercial Fonts may not be included.
OpenType features may not be included in Trial Fonts.
The absence of a particular character or feature in a Trial Font does not grant permission to obtain, reconstruct, modify, or distribute additional characters or functionality.
5. Restrictions
To protect Plomb Type’s intellectual property, you agree not to:
Redistribute, share, sell, lease, lend, sublicense, or otherwise make the Trial Fonts available to third parties.
Upload the Trial Fonts to publicly accessible online storage, code-sharing services, or font repositories.
Use the Trial Fonts in a publicly distributed application, website, template, platform, or other product.
Modify, reverse engineer, decompile, reformat, or create derivative versions of the Trial Font software.
Convert, rename, or alter the Trial Font software for the purpose of circumventing its limitations.
Use the Trial Fonts in any service that allows unlicensed users to generate custom designs, text, or products.
Use the Trial Fonts for NFTs, blockchain projects, or smart-contract technologies without prior written approval from Plomb Type.
Use the Trial Fonts to promote or produce hate speech, discrimination, or illegal activities.
You may import individual characters or text created with the Trial Fonts into drawing or design applications and modify them as graphic objects for permitted testing, presentation, or educational purposes. You may not modify or distribute altered versions of the Trial Font software itself.
6. Client and collaborator use
Trial Fonts may be shared with a client or collaborator solely when necessary to review or present a design concept created using the Trial Fonts.
Any such recipient must comply with this Agreement and may not use the Trial Fonts independently or for any purpose beyond reviewing the relevant project.
The Licensee is responsible for ensuring that Trial Fonts are not distributed or used outside the scope of this Agreement.
7. Ownership and intellectual property
All rights, title, and interest in the Fonts, including all copyrights, design rights, typographic designs, and distinguishing features, remain the exclusive property of Plomb Type and its authors.
No ownership or title passes to you through this Agreement.
Under French law, the moral rights (droits moraux) of the type designer(s) remain inalienable and are retained by their creator(s).
8. Termination
This Agreement remains in effect until terminated.
Plomb Type may terminate this Agreement immediately if you fail to comply with any of its provisions.
Upon termination, or upon completion of your evaluation or educational project, you must:
Cease all use of the Trial Fonts
Delete or destroy all copies of the Trial Fonts in your possession or control.
Any continued use of the Trial Fonts after termination or outside the permitted uses constitutes unauthorized use and may constitute copyright infringement.
9. Warranty and liability
The Trial Fonts are provided “as is” without any warranty, express or implied.
Plomb Type does not warrant that the Trial Fonts will meet your specific requirements, contain all characters or features, or function uninterrupted or error-free.
To the maximum extent permitted by applicable law, Plomb Type shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of or inability to use the Trial Fonts.
10. Governing law and juridiction
This Agreement is governed by and construed under the laws of France.
In the event of a dispute, the courts of Paris, France shall have exclusive jurisdiction.
11. General provisions
This Agreement represents the entire understanding between Plomb Type and the Licensee concerning the Trial Fonts and supersedes any prior agreements or communications concerning their trial use.
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full effect.
Failure or delay by Plomb Type to enforce any right shall not be considered a waiver.
